These Terms of Service ("Terms") govern your use of our platform and any related services provided by The General Media Company, Inc. (doing business as Dreamstate, "we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

Description of Service

Our Service provides AI-powered content generation and analytics, offering insights and tools to help you better understand and optimize your engagement.

Eligibility

Age Requirement

You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that you are at least 18 years old.

Compliance

You agree to comply with all applicable laws, regulations, and policies when using the Service.

Account Registration

You may be required to create an account to access certain features of the Service. You agree to provide accurate and complete information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Use of the Service

You agree to use the Service in compliance with all applicable laws and regulations. You must not:

  • Use the Service for any illegal or unauthorized purpose.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Engage in any activity that could harm or impair the performance or security of the Service.

Intellectual Property

All intellectual property rights in the Service, including but not limited to software, design, text, images, and trademarks, are owned by us or our licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.

Indemnification

You agree to indemnify, defend, and hold harmless The General Media Company, Inc. (doing business as Dreamstate), its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of this Agreement.

Modification and Termination

Modifications

We reserve the right to modify or update this Agreement at any time. We will post the revised Agreement on our website with an updated "Last Updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated terms.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and without notice. Upon termination, all rights granted to you under this Agreement will immediately cease.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Service; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service; and/or (f) the defamatory, offensive, or illegal conduct of any third party.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.

Data Processing Addendum (GDPR)

This Data Processing Addendum ("DPA") applies to customers subject to the European Union General Data Protection Regulation ("GDPR") or Germany's Bundesdatenschutzgesetz ("BDSG") / Datenschutz-Grundverordnung ("DSGVO"). It forms part of these Terms and governs how Dreamstate processes personal data on your behalf.

Roles

You ("Customer") are the Data Controller. The General Media Company, Inc. (Dreamstate) is the Data Processor, acting only on your documented instructions.

What We Process

We process professional contact data that you provide or that is generated through your use of the Service, including names, job titles, company names, and professional communication records. We do not process special-category data (Article 9 GDPR).

Purpose and Legal Basis

Processing is carried out solely to provide the outreach automation and content generation features you have configured. The legal basis for B2B outreach automation is legitimate interest (Article 6(1)(f) GDPR), limited to professional contacts acting in their business capacity.

Our Obligations

  • Process personal data only on your instructions.
  • Ensure personnel are bound by confidentiality.
  • Implement appropriate technical and organizational security measures (Article 32 GDPR).
  • Assist you in responding to data subject rights requests (access, rectification, erasure, portability) within 30 days.
  • Notify you of a personal data breach without undue delay and within 72 hours of becoming aware.
  • Delete or return all personal data upon termination of the Service, at your choice.
  • Make available information necessary to demonstrate compliance and support audits.

Sub-processors

We engage sub-processors to assist in delivering the Service. Each sub-processor is bound by a data processing agreement or equivalent contractual obligations that provide at least the same level of data protection as this DPA. A current list of sub-processors is available on request at info@trydreamstate.com. We will notify you of any intended changes to sub-processors, giving you the opportunity to object before the change takes effect.

International Transfers

Where personal data is transferred outside the European Economic Area (EEA), we rely on the European Commission's Standard Contractual Clauses (SCCs) as the lawful transfer mechanism. Copies of applicable SCCs are available on request at info@trydreamstate.com.

EU AI Act

Dreamstate's AI-assisted content generation constitutes a "limited risk" AI system under the EU AI Act. AI-generated outreach messages are drafted as suggestions and sent under your supervision. You retain full control over what is sent and to whom. No automated decision-making with significant legal effect on data subjects is performed.

DPA Requests

If you require a signed standalone DPA document (e.g., for enterprise procurement), please contact us at info@trydreamstate.com and we will provide one within 5 business days.
